Kruk: If there is some uncertainty on whether or not we trial, it may be grounds for cancellation of the decision

In the jurisdiction of cases which should be considered as Higher anti-corruption court (WACHS) of Ukraine, there is uncertainty. This September 5 on air “Gromadsky”, said the Deputy head of the WAX Eugene Kruk.
He believes that the problematic aspects of the Verkhovna Rada should eliminate the adoption of the law.
“Now there is a conflict of norms, some uncertainty of jurisdiction of WAX, and it should be eliminated. It can be removed to decrease the number of cases and the side of more… the Courts can leave about 200 cases investigated by the NAB [National anti-corruption Bureau of Ukraine], or 3600 all cases, including those that involved other law enforcement agencies. There amount much less than 500 thousand,” said Kruk.
According to him, if uncertainty remains, there is a risk of losing Ukraine to the European court of human rights (ECHR).
“The ECHR is article 6, which requires that the case was heard by the court. If there is some uncertainty on whether or not we trial, it may be grounds for cancellation of the decision,” says crook.
