A subsidiary Bank of the Russian VNESHECONOMBANK in Ukraine was sold in accordance with the Ukrainian legislation, assured the Ministry of justice.

Prominvestbank, which is a subsidiary of the Russian Bank VNESHECONOMBANK, was sold in accordance with the Ukrainian legislation, writing Ukrainsk news on Tuesday, March 10.

Earlier in Russia said that Prominvestbank was sold in violation of international law because previously, the Stockholm arbitration court has banned its sale.

This statement was commented by the Deputy Minister of justice, Commissioner for the ECHR Ivan Hazel.

According to him, the interim decision of the Arbitration Institute of the Stockholm chamber of Commerce dated 28 August 2019 on the adoption of measures to ensure the claim is inherently the decision of the international commercial arbitration is not subject to recognition on the territory of Ukraine in the manner prescribed by Chapter 3 of section IX of the Civil procedure code of Ukraine.

Under this section, the decision of the international commercial arbitration is binding solely after his confession on the territory of Ukraine and providing permission for its execution by the competent court by results of consideration of the corresponding statement. It should also be final and shall take effect only at the expiration of the period for appeal or the completion of appellate review.

“The statement about the existing prohibition of bidding on the basis of the decision of the Arbitration Institute of the Stockholm chamber of Commerce on August 28, 2019 not true, since such a decision is not passed the procedure of legalization on territory of Ukraine and is not binding on third persons and state bodies, — said Hazel.

Earlier, the national Bank stated that it did not interfere in the contractual process of sale of shares of banks. Also, the national Bank does not interfere in judicial decisions.
