Holodnitsky assured that all cases will be closed until March 27

The national anti-corruption Bureau of Ukraine and Specialized anti-corruption Prosecutor’s office until 27 March must close all criminal proceedings that were initiated under the article on illicit enrichment, said the head of the Specialized anti-corruption prosecutors Nazar Golodnitsky at the meeting of the anti-corruption Committee of the Verkhovna Rada of Ukraine. “I have reported on this issue, these data are made publicly available. More than 100 criminal proceedings was the purview of the NEB, and SAP for the entire period of the existence of this article… On 26 February, by the time of the decision of the constitutional court in our jurisdiction remained 65 production… I put NABOO and SAP, all prosecutors, control up to March 27. We won’t hide anything, March 28, I will publish a list with the names of all defendants against whom investigated these criminal proceedings. By this time all these facilities are subject to closure,” said Holodnitsky.

February 26, 2019, the constitutional Court declared article 382-2 of the Criminal code of Ukraine (illicit enrichment) is not relevant to the Basic law and abolished it. The decision States that it is not consistent with the constitutional principle of the presumption of innocence and the constitutional requirement on the inadmissibility of the imposition of liability for refusal to give testimony or explanations against himself, family members or close relatives (article 62 and 63 of the Constitution).

The National anti-corruption Bureau of Ukraine reported that investigate cases of illicit enrichment in the amount of 500 million UAH in the framework of the 65 criminal proceedings, however, after the decision of the constitutional Court, all proceedings on illicit enrichment will be closed.

As of 18 March in Parliament there were several bills on responsibility for illicit enrichment: No. 10103 of the authorship of the leader of the parliamentary faction “Batkivshchyna” Yulia Tymoshenko, No. 10110, which was made to the President of Ukraine Petro Poroshenko and 12 alternative to it.
