The four accused in the case about the crash of flight MH17 in the Donbas denied combatant immunity, which provides an exemption from criminal prosecution of participants in armed conflicts.

This was stated by the Dutch Prosecutor ward Ferdinandusse, transfers “RBC-Ukraine” with reference to the local media. it clarifies that we are talking about Igor Girkin, Sergey Dubinsky, Putalova Oleg and Leonid Kharchenko.

They are, from the point of view of international law, are not combatants and cannot benefit from immunity from prosecution.

According to the Prosecutor, there are two reasons. First, Russia denies its influence on the militants of “DNR”, and this would allow to consider them as representatives of the Russian troops. Second, the representatives of illegal armed groups were not part of an organized military system, and under their control committed major war crimes.

Thus, the prosecution came to the conclusion that the suspects could be prosecuted based on the criminal law of the Netherlands. In addition, the Prosecutor added that the investigation has studied the possibility of extending them to other types of immunity, but no evidence was found.

The Geneva Convention stipulates that combatants are active participants of armed conflict who are subject to special rules. Under certain circumstances they may be exempt from criminal prosecution.

As reported by OBOZREVATEL, the public Prosecutor’s office has declared readiness to consider the case in fact of arms, which was shot down flight MH17, but also in relation to the identities of the accused.

We will remind that on March 9 in the Netherlands, began hearing the case of the crash of the Boeing 777 that was shot down over the Donbas 17 July 2014. The accident killed 298 people on Board.
