All participants whose applications were not accepted for the tender of “Ukrzaliznytsia”, have filed complaints in the AMC

May 20, Board for appeal on public procurement of the Antimonopoly Committee of Ukraine shall consider the complaints of bidders for the purchase of fuel and lubricants for Ukrzaliznytsya, writes OilPoint.

The portal writes that in recent years, such tenders “Ukrzaliznytsia” has won the Kiev factory of KSM and Berdyansk plant “Agrinol”, as the company in November 2017 by decision of the Board introduced the special admission procedures, which allowed automatically to cut off the “extra” participants. In 2018, the two companies received in the amount of contracts, UAH 0.5 billion.

In 2019, two new players – LLC “cornet holding” and OOO “hill Corporation-Ukraine” managed to appeal to the Antimonopoly Committee of non-admission to the auctions, so OilPoint writes, “Ukrzaliznitsya” applied a new approach – bidders must provide evidence that supplied their products to the customer in the period 2015-2017 and the acts of inspection of their production.

“However, others have to settle for the loss to enforce the contract in the event of failure of the standard until the first delivery. According to the author of the material, if you take, for example, a tender of the expected value of 130 million, this amount will be 5% of the contract value and will fluctuate in the range of 6 million UAH”, – said in the article.

“It should be understood that each tender is purchased from five to seven varieties of oils and obtaining authorizations for each of them requires time, in some cases up to several months. Given the bureaucratic system that was inherited from the Soviet Union, obtaining such tolerances in a reduced time is impossible,” – said an unnamed source OilPoint.

Favorites of past purchases thus again gain the advantage, but the two most recent tender of “Ukrzaliznytsya” for 130 million UAH came nine and 12 companies, and offers all of the favorites from previous years were rejected because of the same error – they provided the technical conditions of production are not in full.

All participants whose applications were not accepted for tender, filed a complaint with the AMC, the portal writes.

“Overall, despite the obvious problems, traders note some progress in the procurement activities of Ukrzaliznytsia, as evidenced by the penetration of new players into the tenders for the first time in many years,” – emphasizes the publication.

Point in the procurement schemes should deliver a Board meeting of the AMC on appeal of public procurement, the authors of the article.
